This Refund Policy (“Policy”) governs the refund terms and conditions related to the sign-up fee in connection with the Referral Agreement executed with Care Business Consulting. This Policy is effective for 60 days with Care Business Consulting from the date of the Referral Agreement’s execution.
Refund Eligibility:
Eligibility is subject to specific terms and conditions outlined in the original purchase agreement:
- Less Closing Ratio: In the event that Lead (s) provided by Care Business Consulting doesn’t give you enough closing ratio by the end of the year (Silver – at least 10%, Gold/Diamond – 15%).
- Failure to Provide Leads by Care Business Consulting: In the event that Care Business Consulting fails to deliver any leads to the agent/broker as stipulated.
iii. Non-Exclusivity of Leads: If the lead provided to the agent/broker lacks primary exclusivity and has been shared by Care Business Consulting with other agents/brokers within its network.
- Lead’s Reluctance to Engage in Business: If the lead(s) provided by Care Business Consulting demonstrates an unwillingness to participate in business activities within a period of 9 months from the date of assignment.
- Pre-existing Contract: In cases where the lead provided by Care Business Consulting is already under contract with the agent/broker at the time of assignment.
- Non-Responsiveness of Leads: If the lead(s) provided by Care Business Consulting remains unresponsive for a continuous period of 10 working days.
vii. Acceptance of Leads Outside Preferred Location: Should the Agent/Broker opt to receive leads from zip codes/areas outside of their preferred location, such leads shall be considered part of their monthly allocation and, therefore, ineligible for refund or replacement on this basis. The acceptance of a lead provided by Care Business Consulting by an Agent/Broker renders them ineligible to file a dispute or claim a chargeback. The acceptance of a lead by an Agent/Broker is confirmed when they receive the lead and do not raise any objections within 48 hours, after which the lead is considered accepted.
Refund Procedure:
- In the case of scenario b(i) of the Refund Policy, the agent/broker shall initiate the process by sending a reminder to Care Business Consulting, requesting the provision of the lead(s). Should Care Business Consulting fail to provide the lead(s) within one month from the date of the reminder, the agent/broker may proceed to submit a claim for a refund, if eligible.
- In the case of scenarios b(ii) to b(v), the agent/broker shall promptly report the matter to Care Business Consulting, along with supporting evidence, and request the replacement of the lead(s). In the event that Care Business Consulting fails to effectuate the replacement within one month from the date of reporting the matter, the agent/broker may proceed to submit a claim for a refund of the sign-up fee, if eligible.
Timely Reporting:
It is incumbent upon the agent/broker to dispatch the reminder or report concerns related to lead replacement to Care Business Consulting within a maximum period of 48 hours from the acceptance of the referral. Failure to comply with this stipulated timeline shall result in the leads being deemed satisfactory, thereby rendering them ineligible for either replacement or refund.
Eligibility for a refund is contingent upon signing the agreement. Without a signed agreement, the refund policy does not apply.
This Refund Policy takes effect as of the Effective Date mentioned above and supersedes all prior versions. By accepting the Referral Agreement with Care Business Consulting, you acknowledge and consent to adhere to the terms outlined herein.
